Abstract: In view of the problems such as the plurality of subjects, unclear responsibilities and powers, the lack of remedies when the parties disobey, and the delay in amending laws and regulations, etc., ″railway traffic accident identification book″ on the basis of the establishment of the subject, the main content, the nature of attributes, remedies and other aspects were analysed specifical .The results show that responsibility subject of railway traffic accident investigation should be further clarified, and the revision of laws, regulations and rules of railway industry should be accelerated.The remedy mode of refusing to accept the written confirmation of railway traffic accidents should be made clear, and the construction of railway administrative law enforcement team should be strengthened.
